Proposed Changes to the Prince Edward Island Employment Standards Act
The Department of Economic Growth, Tourism and Culture is inviting organizations and the general public to provide feedback on proposed changes to the Employment Standards Act. The proposed changes will be considered by the Legislative Assembly of PEI as a Bill to amend the Employment Standards Act.
About the Proposed Changes
The Bill contains housekeeping amendments to correct the title of the Minister responsible for the administration of the Act, as well as correction to the parental leave provision, to make the periods of time referred to in subsection 22(2.1) consistent. The most significant change involves a change to the Bereavement Leave provision.
Proposed Change to Bereavement Leave:
The proposed changes include:
- Clarification that bereavement leave is available to an employee who experiences the end of a pregnancy by way of miscarriage or stillbirth;
- Providing bereavement leave to an employee whose spouse or partner, or former spouse or partner, has experienced a miscarriage or stillbirth where the employee would have been the biological parent;
- Clarification of the language around the timing of the leave in subsections (1) and (2).
