In the matter of Calls to Residences by Registrants - Cold Calling

Whereas:

The Prince Edward Island Securities Office, having considered that to do so would not be prejudicial to the public interest, makes Order 33-503 in the matter of “Calls to Residences by Registrants - Cold Calling.”

It is ordered pursuant to section 16 of the Securities Act, R.S.P.E.I. 1988, Cap. S-3.1 (the “Act”), that:

Part 1 - Exemption Order

1.1 The restrictions on a person attending at or telephoning to any residence, as set out in section 158 of the Act, do not apply to a dealer that is registered in Prince Edward Island or to an individual registered to trade securities on behalf of a registered dealer.

1.2 Notwithstanding paragraph 1.1, the Superintendent may by order suspend, cancel, restrict or impose conditions upon the right of any registrant or class of registrants named or described in the order to:

a) call at any residence; or

b) telephone from within Prince Edward Island to any residence within or outside Prince Edward Island for the purpose of trading in any security or class of securities.

Part 2 - Opportunity to be Heard

2.1 The Superintendent shall not make an order under paragraph 1.2 without giving the person or class of persons an opportunity to be heard.
