Distracted Driving
It is illegal to text, dial, chat, email or search using a hand-held communication device while driving on Prince Edward Island. This includes use of:
- cell phones
- 10-4 phones
- GPS systems
- laptops
Calls to 911 are exempt as are calls from the driver of an ambulance, fire department vehicle or police vehicle.
Fines and Consequences
Drivers who use a hand-held communication device while driving could face fines ranging from $575 to $1,275 and five (5) demerit points upon conviction.
Under the cell phone law (Section 291.1 Highway Traffic Act), no one shall drive a motor vehicle on a highway while holding or using a hand-held wireless communication device that is capable of receiving or transmitting telephone communications, electronic data, email or text messages.
New drivers are reminded of the Graduated Driver Licensing Program, where no person who is a Stage 1 driver or a newly licensed driver, shall use a hand-held cell phone, headphones, MP3 player, portable video games or any other hand-held electronic device while operating or having care and control of a motor vehicle.
Added Consequences for Passing a School Bus
Failing to stop for a school bus when the red lights are flashing will lead to a loss of 12 demerit points, resulting in licence suspension for three months. This is in addition to a fine of up to $5,000.

Safe Alternatives
Drivers can use hands-free technology activated by a single touch to a button. Alternatively, when it is safe to do so, drivers can pull over and stop the vehicle to talk, email or check a map.
