Feedback wanted about proposed changes to the Off-Highway Vehicle Act

The province is inviting residents to share their opinion about proposed changes to allow municipalities to make decisions about operating ATVs on roads within the municipality.

Some municipalities, along with the PEI ATV Federation and its member clubs, have requested options to improve ATV access within municipal boundaries and to better connect trail systems for recreation, tourism, and businesses. 

The proposed legislative changes would provide new enforcement powers for municipalities to help ensure ATVs are used safely and legally. Fines for unauthorized ATV use on roads would double to encourage safe riding. The proposed changes aim to balance expanded access for ATV users and stronger enforcement to protect both public safety and infrastructure.

Key features of the Off-Highway Safey Act proposed changes:

  • Municipal participation is voluntary. Each community can decide what works best for its local needs and priorities.
  • Before making any rules about ATV use, municipalities must apply to the Minister of Transportation and Infrastructure for approval.
  • Municipalities must clearly identify which highways are open to ATVs and post signage. 

The proposed fines for all off-highway vehicles driving on any PEI road where they are prohibited are:

  • First offence: increase from $250 -$500 to $500 - $1,000
  • Repeat offences: increase from $500 - $1,000 to $1,000 - $2,000

Public consultation follows engagement with municipalities and law enforcement. The consultation closes on Tuesday, September 30, 2025.
