What is a Deferred Custody and Conditional Supervision Order?
A Deferred Custody and Conditional Supervision Order is a court order which sentences a youth to custody but allows them to serve the sentence in the community, provided that they comply with strict supervisory conditions imposed by the Court.
Who Supervises Deferred Custody and Conditional Supervision Orders?
On PEI, Deferred Custody and Conditional Supervision Orders are supervised by Youth Justice Workers who work at Youth Justice Services.
How Long Can a Deferred Custody and Conditional Supervision Orders last?
A Judge can impose a Deferred Custody and Conditional Supervision Order for any length of time to a maximum of six months.
What happens if conditions of a Deferred Custody and Conditional Supervision Order are not followed?
If conditions of the order are not followed, the youth may be arrested and detained in custody until their court hearing. If it is deemed there was a breach of the Deferred Custody and Conditional Supervision Order, then the Judge has the following options:
- Cancel the suspension of the Deferred Custody and Conditional Supervision Order and change the conditions in the community, or
- Have the youth serve the remainder of time in custody for two thirds of the time and the remaining one third in the community.
